The running mate of the National Democratic Congress (NDC), Prof. Jane Naana Opoku-Agyemang, has expressed serious concerns about the high-handed treatment meted out to peaceful protesters of the recent three-day demonstration in Accra.
The reports of manhandling, arrests, starvation, denial of access to family and legal counsel by the police as well as the subsequent remand of the protesters, including a pregnant lady, by an Accra Circuit Court are alarming.
Prof. Opoku-Agyemang said the response of the authorities is brutal and high-handed raises questions about the government’s commitment to its so called fight against illegal mining and the destruction of Ghana’s waterbodies, forest and farmlands.
She says she expects the authorities to re-direct their clampdown on the protesters toward a genuine fight against illegal mining and its harmful effects on waterbodies, the health of the people, destruction of cocoa farms and the implications for food security.
“It is incongurous that those actively behind illegal mining are freely walking about and smiling all the way to the bank while protesters who are concerned about the harmful impact of illegal mining are rather being suppressed” she said.
Prof. Opoku-Agyemang urges the government to desist from suppressing the right of Ghanaians to protest, especially as protests are fundamental to human rights.
“These feudal, authoritarian and early century reactions by the government to a peaceful protest have no place in a 21st century democracy. The government must therefore immediately end the persecution of the protesters and unconditionally release those in custody.”

An energy policy expert,JK Owusu-Boakye,aka General Abito, has advised the government through the Ministry of sanitation to urgently engage Zoomliion ( a leading waste management firm), to set up industrial plants to turn waste to electricity generation, turn smoke to sterilize vapour and residue waste as asphalt for road construction.
According to him, apart from safeguarding the environment, it would also go a long way to create jobs and skills for thousands of Ghanaian youth.
General Abito said Singapore generates 250,000 containers of waste daily, 365 days and generate electricity for the city – country and over 60,000 employment, dem stile smoke into atmospheric vapour and used residue as road asphalt.
According to him,this is a game changing waste to energy mechanism, making the city-country clean and out of waste.”This can be done in Ghana (Accra) to get it cleaned as the president said.
Fortunately, for Ghana we have Zoomlion Waste Management Company, that can turn this policy to workable practice of cleaning Accra and our communities, what are we waiting for?, he asked.
The Energy policy consultant explained that, Zoomlion is in every district in Ghana, and as local giant in the Waste Management, there is no gainsaying that Ghana can turn a waste menace to positive socio-economic gains for development in its energy transition agenda 2050.
He advised that Zoomlion should partner the Youth Employment Agency (YEA) to create a Youth in Waste-to- Energy module to capture this new ‘clean city of waste’ ,employment generation policy in Ghana set on the lines of what is in Singapore.
The Pharmaceutical Society of Ghana (PSG) has warned that the country risks importing water to support local pharmaceutical production if the illegal mining canker is not addressed urgently.
The society made this warning at its 2024 annual general meeting, citing the devastating impact of illegal mining on water bodies and the subsequent increase in the cost of treating water for manufacturing.

According to PSG, the treatment of water for local production of pharmaceutical products is becoming increasingly expensive due to the environmental degradation caused by illegal mining activities.
The society emphasised that this added cost contributes to the high cost of medicine in Ghana.
The PSG President, Dr Samuel Kow Donkoh, warned that if measures are not taken to address the illegal mining menace, Ghana may soon face the reality of importing water to support local manufacturing industries.
He noted that Ghana’s local manufacturers currently produce all the infusions needed in the country, but they require quality water to do so.
The society is urging the government to put stringent measures in place to tackle illegal mining activities, which threaten the sources of water used for various purposes.
“The activities of illegal miners in particular have devastated our water bodies, making it increasingly expensive for pharmaceutical companies to treat water for their manufacturing processes. Ghana currently enjoys self-sufficiency in local production of infusions but illegal mining threatens this achievement.
“If this environmental degradation continues, we may soon face the grave reality of importing water to support our local manufacturing industry. The pollution from these mining activities is so severe that expensive technology is also required to treat water, contributing to the high cost of medicines. We therefore call on the government to take urgent decisive action to end this lawlessness.”

Mr. Kyerematen said the proposed process outlined above mirrors a “forensic audit” being advocated for by a section of the Ghanaian public and ought to come up with a voter register acceptable to all contestants and voters in the upcoming 2024 General Elections.
“The timeline proposed for the exercise is from the 30th of September, 2024 to the 11th of October, 2024. This would enable the EC to release a Final Voters Register by the 14th of October 2024.”
“M4C and ARC believe that approaching the resolution of the doubts around the Voters Register in such a joint manner ensures transparency of intent that would settle any lingering issues around the Voters Register, and position the country for a free, fair, transparent, and credible General Elections on December 7, 2024,” he stated.

The Chief Executive Officer of the National Health Insurance Authority (NHIA), Dr Dacosta Aboagye , has commended the government for its robust policy initiatives aimed at digitalizing the operations of the National Health Insurance Scheme (NHIS). Speaking on the Wontumi Radio morning show in Accra, Dr. Aboagye highlighted the positive impact of merging the Ghana Card with the NHIS card, a move he described as a game-changer in the healthcare sector.

Dr. Aboagye noted that the integration of the Ghana Card with the NHIS card has significantly boosted enrollment, providing access to healthcare services for millions of Ghanaians. “This innovative approach has simplified the process for members, enabling more people to register and renew their NHIS membership conveniently. As a result, we’ve seen a substantial increase in the number of active members, which is a critical step towards achieving Universal Health Coverage in Ghana,” he stated.
He further revealed that one of the new reforms being implemented by the NHIA is a policy to add children between the ages of 6 to 14 years onto the NHIS by funding the payment of their Ghana Card. “This initiative will ensure that children within this age bracket can access healthcare services, further advancing our goal of achieving universal health coverage. With the merger of the Ghana Card and the NHIS card, we are well on our way to making healthcare accessible to every Ghanaian,” Dr. Aboagye added.

The NHIS, established in 2003, is a pioneering social intervention program designed to provide affordable and accessible healthcare to all residents of Ghana. Over the years, the scheme has undergone several reforms aimed at improving efficiency, sustainability, and coverage. The recent digitalization efforts, including the introduction of electronic claims processing and mobile renewal systems, have transformed the scheme’s operations, making it more responsive to the needs of the population.

LAWYERS IN SEARCH OF DEMOCRACY (LINSOD) SEES THE HANDS OF GOVERNMENT IN THE DENIAL OF BAIL FOR DEMOCRACY HUB DEMONSTRATORS
On September 22nd and 23rd a group of Ghanaian citizens called ‘Democracy Hub’ had embarked on
a demonstration to register their disappointment at the Government of Ghana’s failure to curb the
illegal mining (Galamsey) menace, which is causing unimaginable havoc to our water bodies, the
environment, and is an existential threat to the entire nation. The group had intended to
demonstrate for three (3) days, but on the second day of their demonstration, some of their leaders,
together with over thirty members were arrested and manhandled by the police on the basis of the
allegation that some public properties were defaced by some of the demonstrators during the
demonstrations.
Those arrested were taken into custody at various police stations in the capital and were denied
access to their families and lawyers who were ready to provide them free legal services to secure
their liberty as guaranteed by the Constitution 1992. After the police had detained them for over 48
hours, some of them were arraigned before two Circuit Courts in Accra on Tuesday, September 24th,
2024 and charged with Conspiracy to Commit Crime, to wit, Unlawful Assembly and Causing Unlawful
Damage, among others.
Rather shockingly and regrettably, where Rule of Law is most expected, the Circuit Courts refused to
grant bail to all of the accused person en-bloc and remanded them into police and prison custody
with a return date of 8th October for some, and 11th October for others (two weeks from now),
only for mention. In an official statement issued by the police thereafter, the police explained that
the Office of the Attorney General had taken over the case and was responsible for the proceedings
at the circuit courts on behalf of the State.
In the objective view of LINSOD, the refusal of bail to the demonstrators, who, whether or not have
caused some minor destruction to public property, on one hand, and remanding them to re-appear in
court after two weeks, on the other hand, are unusual, and obviously not normal. It is reminiscent of
regimes of brutal dictatorships and authoritarian rule, which we thought we had moved away from
It is because courts of justice in democracies, and in normal times, do not, and must never, subject mere demonstrators to the kind of ruling made by the circuit courts in Accra yesterday that we have come to the conclusion that the hands of government is hugely behind this ill-treatment of the
demonstrators.
5. Again, the very fact that the Office of the Attorney General had run to the circuit courts-where the
practice is normally for the police to represent the republic-and took over the prosecution, and
prayed that the demonstrators be remanded instead of admitting them to bail as would reasonably
be expected in a proper democracy where the rule of law works, reveals amply that the ruling NPP
Government is behind the brutality of the demonstrators.
6. What shocks our minds is that the courts in this case sided with the government to subject the
demonstrators to inhumane treatment, and abuse of their rights without even considering the cause
the demonstrators were fighting for, which is the “galamsey” menace.
7. LINSOD, firstly as a body of lawyers, know that by law, the continuous detention of suspects before
their trial, is tantamount to punishing them for the alleged crime of which they are charged, and
before they are even convicted of same. Accordingly, bail must not be denied to suspects unless it is
reasonably believed that they shall not reappear in court when they are on bail; or they shall
interfere with the further investigation of the charges against them, among others. In this
particular instance, some of the demonstrators who are held remanded into custody are pregnant
women, children; asmathic and diabetic patients, who are no flight risk at all. Many of them are
ordinary law-abiding Ghanaian citizens from responsible families.
8. Again, LINSOD, as lawyers pushing for adherence to proper democratic tenets in Ghana, we know
that nowhere in proper democracies, all over the world will demonstrators who have not
murdered or assaulted anyone, and have not attacked law enforcement personnel, or cause and
considerable and extensive damage to important public property are held in custody for more than
48 hours. The opposite can happen only in despotic regimes, which we thought we had moved away
from in Ghana since over three(3) decades ago. Demonstrations, being essential tools for resistance,
and for pressing home demands of a group of people in democracies, is to be encouraged, and one
way of doing that is for the courts to protect demonstrators against the long arms of Government
and the police.
The arrest and remand of the “Stop Galamsey” demonstrators is obviously intended to suppress the free assembly and free speech of citizens. It is a tactic by the Government of Nana Akufo Addo to send fears among other citizens who may have reason to demonstrate against the regime in an
election year as this.
Our courts should have never advanced these motives of an authoritarian government. Our courts are supposed to be on the side of democracy, and for that matter, on the side of the demonstrators.
This is why LINSOD believes that it was wrong for the demonstrators in question to be refused
bail by a court in a democracy such as ours, where we believe the rule of law must be supreme.
11. It is pathetic that the authorities in Ghana have not learned any lessons from citizens uprising in neighbouring countries. Such uprisings invariably, start, as happening here, by a first demonstration,during which the police shall be high-handed and arrest demonstrators unnecessarily, and the courts
would refuse those arrested bail, all with the intention to suppress any further action by the people.
Unfortunately, these methods do not work any longer when the people have had enough. The
methods rather escalate the resistance, and eventually, it snowballs into something dangerous, but which could have been avoided if the authorities had decided to be cautious and chose to engage the demonstrators instead of brutalizing them.
12. In order to avoid any escalation in the near future, we of LINSOD hereby call on the Ghana Bar
Association (GBA) and other Civil Society Organizations to join us in demanding for the immediate
release of the demonstrators to their families. This shall serve our democracy better.

A group of lawyers has filed a petition against the Ghana Police Service at the Commission on Human Rights and Administrative Justice (CHRAJ) for allegedly violating the rights of demonstrators at the recent StopGalamsey protest.
The Democracy Hub organised a three-day protest to press home their demands for government to swiftly end the illegal mining activities in the country.
According to the group, the menace was robbing Ghana of its natural resources and endangering the lives of future generations.
However, the protest witnessed several arrests forcing only two individuals to show up for the final day of the protest.
So far, some 39 people have been remanded into police and prison custody, with others yet to appear before the court, including one of the leaders of the group, Oliver Barker-Vormawor.
On the back of this, in a petition signed by a representative of the lawyers, Timothy Selikem Donkor, the petitioners requested that CHRAJ commence an immediate investigation into the police’s violation of the protesters’ rights.
The outlined areas for the investigation include a probe into unlawful arrests of protesters, unlawful detention without providing food, acts of unprofessional conduct, and violation of the right to counsel.
The petition also requests that immediate legal action be taken to ensure that these violations cease and that the police officers involved are dealt with per the law.

The National Democratic Congress (NDC) has condemned the remand of 28 protesters of the Democracy Hub into police custody and 11 others into prison custody.
This follows a decision by the Accra Circuit Court on Tuesday, September 24. The demonstrators were charged with conspiracy to commit a crime, namely; unlawful assembly.
In a statement signed by the NDC’s National Communications Officer, the NDC said it views this action as a grave abuse of power, accusing the governing Akufo-Addo/Bawumia government of despotic behaviour.
“We condemn in no uncertain terms the high-handedness of the Ghana Police Service and their evil collaborators in the despotic Akufo-Addo/Bawumia government. It is totally reprehensible for the Police to subject civilian protestors, who are merely expressing their anger against the vexed matter of illegal mining, to such barbaric and inhumane treatment,” the September 25 release read.
The protesters, who had been participating in a three-day demonstration organised by Democracy Hub, were protesting against the devastating effects of illegal mining on Ghana’s environment.
The NDC said the protesters were met with undue force from the Ghana Police Service, leading to several arrests.
The NDC described the arrests as brutal, claiming that innocent civilians were unfairly targeted.
The party expressed concern over reports from families and legal representatives, who have claimed they have been denied access to the arrested protesters, some of whom have been deprived of necessities such as food and water. This, the NDC believes, further highlights the unjust treatment meted out to the demonstrators.
The party also criticised the Accra Circuit Court’s decision to remand the protesters, pointing out that their offences were classified as misdemeanours. The NDC reiterated that the right to protest is a fundamental human right and should not be obstructed by excessive police and judicial actions.
The press release also denounced the government, accusing it of misusing police resources to suppress protests while failing to address the illegal mining crisis that has led to severe environmental degradation. The NDC asserted that the real criminals in this situation are the government officials and ruling party functionaries involved in illegal mining, who should face prosecution instead.
